By accessing, browsing, or using any portion of these Websites — including submitting a service request, communicating with dispatch personnel, or receiving referral information — you (“User,” “Customer,” or “Client”) agree to comply with and be legally bound by the following Terms and Conditions (“Terms”).
If you do not agree to these Terms, you must immediately discontinue use of the Websites and any related Services.
1. Scope of Services
ZiaTow.com / ZiaTowing.com operates as a dispatch and referral coordination platform, connecting customers with independent third-party towing and roadside service providers (“Service Providers”) located throughout the United States of America, including all 50 states and the District of Columbia.
ZiaTow.com / ZiaTowing.com does not own, operate, or control any tow trucks, wreckers, or roadside service equipment. We do not directly perform towing, recovery, vehicle transport, repair, or storage. Our role is limited to facilitating communication between users and independent Service Providers capable of performing such services under their own authority.
All services are performed by independent contractors, not by ZiaTow.com / ZiaTowing.com. Any agreements for services are strictly between you and the Service Provider.
2. Independent Contractor Relationship
Each Service Provider to whom ZiaTow.com / ZiaTowing.com dispatches or refers a request is an independent entity. ZiaTow.com / ZiaTowing.com does not supervise, manage, or guarantee their operations, conduct, or compliance with any regulations.
By using our Websites, you acknowledge and agree that:

Service Providers are solely responsible for the services they perform and for maintaining all required licenses and insurance.

3. Nationwide Dispatch Coverage
ZiaTow.com / ZiaTowing.com provides dispatch coordination and referral services across the United States. Laws, insurance requirements, and regulations vary by state and locality.
By using our Services, you acknowledge that it is your responsibility to ensure that any Service Provider dispatched to you complies with applicable state and local regulations, including but not limited to licensing, towing permits, and insurance coverage.
4. No Warranty or Guarantee
The Websites and Services are provided strictly “as is” and “as available.”
ZiaTow.com / ZiaTowing.com makes no warranties, representations, or guarantees of any kind, express or implied, including but not limited to:

The accuracy, timeliness, or completeness of dispatch information,

The reliability, capability, or professionalism of any Service Provider,

The condition, legality, or safety of equipment used,

Continuous, uninterrupted access to the Websites or phone systems.
All risks associated with use of the Services are assumed by you.
5. Limitation of Liability
To the fullest extent permitted by law, ZiaTow.com / ZiaTowing.com, its owners, representatives, affiliates, and agents shall not be held liable for any direct, indirect, incidental, consequential, punitive, or exemplary damages, including but not limited to:

Vehicle or property damage,

Delayed service, loss, or theft,

Personal injury or death,

Data loss, emotional distress, or inconvenience,

Business interruption or lost profits.
In no event shall ZiaTow.com / ZiaTowing.com’s total cumulative liability to you exceed fifty U.S. dollars ($50.00), regardless of the cause of action, even if ZiaTow.com / ZiaTowing.com has been advised of the possibility of such damages.
6. User Responsibilities
By submitting a dispatch request or using the Websites, you affirm that:

You are the lawful owner, operator, or authorized agent for the vehicle or property in question;

All information you provide is accurate and truthful;

You will cooperate with Service Providers and comply with their instructions;

You will pay the Service Provider directly for all agreed services unless otherwise stated;

You will not use the platform for fraudulent, misleading, or abusive purposes.
Misuse of the Websites or Services may result in denial of service and potential reporting to law enforcement.
7. Payment and Pricing
All pricing, estimates, and rate information provided through ZiaTow.com / ZiaTowing.com are for coordination purposes only. Final pricing and payment terms are determined solely by the independent Service Provider performing the work.
ZiaTow.com / ZiaTowing.com does not set or control service fees, arrival times, or transaction terms. Unless explicitly stated, all payments are made directly to the provider at the time of service.
8. Insurance and Risk Disclosure
ZiaTow.com / ZiaTowing.com does not provide or maintain commercial towing insurance, garage keepers coverage, or on-hook liability insurance, as ZiaTow.com / ZiaTowing.com does not perform towing or roadside services directly.
Each Service Provider operates independently and is responsible for maintaining its own insurance. You are strongly encouraged to verify a provider’s coverage before service begins. ZiaTow.com / ZiaTowing.com assumes no liability for uninsured or underinsured service providers or for any damages that occur during third-party service.
9. Dispute Resolution
Any dispute, claim, or issue related to pricing, timing, quality, or service performance must be addressed directly with the Service Provider that performed the service.
ZiaTow.com / ZiaTowing.com does not mediate or arbitrate disputes between users and independent providers and has no obligation to become involved in such matters.
You agree to hold ZiaTow.com / ZiaTowing.com harmless from any legal claims or damages arising from third-party disputes.
10. Indemnification
You agree to indemnify, defend, and hold harmless ZiaTow.com / ZiaTowing.com, its owners, affiliates, and representatives from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) resulting from:

Your use or misuse of the Websites or Services,

Your breach of these Terms,

Your violation of applicable law or third-party rights, or

Any disputes involving third-party Service Providers.
11. Modifications and Termination
