1. Introduction
This Payment & Anti-Fraud Policy (“Policy”) describes the payment methods accepted by ziatow.com / ziatowing.com, how payments are processed, our practices for detecting and preventing payment fraud, and your obligations and remedies in the event of suspected fraud, unauthorized transactions, or disputes. By authorizing a payment for services coordinated through the Platform, you agree to the terms of this Policy.
2. Payment Processing; Third-Party Processors

Payment Processors: All electronic payments for services arranged or facilitated through ziatow.com / ziatowing.com are processed exclusively by Stripe, PayPal, or other third-party processors we expressly authorize and announce on the Platform (“Processors”). ziatow.com / ziatowing.com does not itself process or store raw credit card numbers, ACH credentials, or bank account information unless explicitly stated in writing.

Processor Terms Prevail: Use of a Processor is governed by the Processor’s terms of service, privacy policy, and user agreements. You acknowledge that any payment made by you is also subject to the Processor’s rules and dispute procedures. ziatow.com / ziatowing.com does not control those rules and is not responsible for them.

PCI / Data Handling: To the extent that cardholder or payment data is collected through the Platform, such data is captured, transmitted, and stored only via the Processor’s secure systems (e.g., hosted payment pages, tokenization). ziatow.com / ziatowing.com does not intentionally store raw payment card data on its servers. If you voluntarily transmit sensitive payment information by any non-Processor channel, you do so at your own risk.
3. Authorization; Who May Pay

Authorized Payer: Only the authorized cardholder, account holder, or authorized representative may initiate payments. By providing payment details, you represent and warrant that you are authorized to use the selected payment method and that the payment method has sufficient available funds or credit.

Verification: ziatow.com / ziatowing.com reserves the right to require additional verification (photo ID, billing address verification, confirmation calls, or other documentation) prior to accepting or releasing funds or before dispatching services. Refusal to provide reasonable verification may result in cancellation, refusal of service, or holding of funds pending resolution.
4. Pre-Authorization, Holds, and Deposits

Estimates and Holds: For certain services (e.g., long-distance tows, transports, or high-value shipments), the Platform or the selected Carrier may require a pre-authorization, deposit, or temporary hold on your payment method. Such holds are not final charges and may reduce your available credit until released by the Processor.

Final Charges: Final amounts are set by the independent Service Provider and may differ from estimates. You authorize the Provider (or its agent) to charge the final agreed amount to the payment method you provided.
5. Chargebacks, Disputes, and Unauthorized Transactions

Notify the Provider First: If you believe a charge is incorrect, unauthorized, or otherwise disputed, you must first attempt to resolve the matter directly with the Service Provider who performed the service and who received payment. ziatow.com / ziatowing.com is primarily a coordination platform and is not the merchant of record for third-party services unless explicitly stated.

Notify the Platform Promptly: You must also notify ziatow.com / ziatowing.com at support@ziatow.comwithin 48 hours of discovering an unauthorized or disputed charge and provide all requested information and documentation (photos, receipts, tracking/dispatch numbers, screenshots, ID). Prompt notification is required to enable timely investigation and cooperation with Processors and law enforcement.

Chargeback Enforcement & Cooperation: If you file a chargeback with your bank or card issuer, the Processor and ziatow.com / ziatowing.com will cooperate in good faith in any resulting investigation. You agree to provide truthful statements and any requested documents. False or fraudulent chargebacks may result in civil and criminal liability and will be contested by ziatow.com / ziatowing.com to the fullest extent allowed by law.

Fees for Chargebacks: If a chargeback is found to be invalid and the Processor or ziatow.com / ziatowing.com incurs administrative fees, processing fees, or other costs due to a chargeback you initiated (including costs assessed by a Carrier), you agree to reimburse the Platform for such fees and costs, in addition to any amounts recovered from the Carrier. ziatow.com / ziatowing.com reserves the right to recover such fees from you directly or to offset them against any other balances or refunds owed.
6. Stolen Cards, Unauthorized Use, and Fraud Detection

Immediate Reporting: If you suspect your payment method has been stolen, compromised, or used without authorization, notify your bank or card issuer immediately and notify ziatow.com / ziatowing.com at support@ziatow.com.

Fraud Detection Tools: The Platform and Processors may use automated fraud detection, machine learning, geolocation checks, AVS (address verification), CVV checks, device fingerprinting, velocity rules, and manual review to detect suspicious transactions. These measures may result in declines, holds, or additional verification steps.

Refusal or Suspension: ziatow.com / ziatowing.com reserves the right to refuse, delay, or cancel any transaction or booking that appears fraudulent, suspicious, or otherwise in violation of this Policy, without prior notice. We may also suspend associated user accounts and preserve transaction data for investigations.

Law Enforcement Cooperation: When fraud is suspected, ziatow.com / ziatowing.com may share transaction data, user information, and other permissible records with banks, Processors, and law enforcement agencies as required or permitted by law.
7. Refunds, Cancellations, and Charge Conditions

Refund Policy: Refund eligibility, timing, and amounts are governed by the Service Provider’s refund and cancellation policies, unless ziatow.com / ziatowing.com is explicitly the merchant and states otherwise. Any request for refunds must be made promptly and follow the Provider’s stated procedure.

Cancellation Fees: Independent Service Providers may impose cancellation, standby, or call-out fees. These fees are determined by the Provider; you agree to pay any applicable cancellation charges they impose.

Platform-Initiated Refunds: In limited circumstances where ziatow.com / ziatowing.com has directly collected funds and elects to issue a refund, refunds will be processed through the original payment method via the Processor and may be subject to Processor timing and hold policies. The Platform is not responsible for Processor delays in crediting refunds to your account.
8. Limits, Holds for High-Risk Transactions, and Account Suspension

Transaction Limits: ziatow.com / ziatowing.com may impose transaction limits, limits on total daily or monthly charges, or require escrow in cases of unusual volume, high value, or high-risk activity.

High-Risk Review: High-value or out-of-pattern transactions may be subject to manual review and temporary holds. You consent to such reviews and understand they may delay service.

Suspension & Collections: The Platform reserves the right to suspend accounts, withhold funds, or refer unpaid balances to collections (including billing back Processor fees) where fraud, chargebacks, or suspicious activity is detected.
9. No Liability for Processor Failures
z i a t o w . c o m / z i a t o w i n g . c o m is not responsible for Processor outages, payment gateway failures, bank declines, or network interruptions that prevent, delay, or impede payment. Billing disputes related to Processor actions must be taken up with the Processor under their dispute processes. The Platform will assist when reasonable, but cannot guarantee outcomes.
10. Cardholder Data & Privacy

Data Use: ziatow.com / ziatowing.com may collect certain billing and contact details (name, email, billing address, last four digits of card, transaction ID) for reconciliation, refunds, fraud detection, and compliance. Such data is handled in accordance with our Privacy Policy.

No Storage of Full Card Numbers: Except where explicitly and securely facilitated by a Processor, the Platform does not store full payment card numbers, expiration dates, or CVV codes. If you submit payment data outside a Processor-managed flow, you do so at your own risk and ziatow.com / ziatowing.com disclaims responsibility for insecure transmission.
11. Merchant of Record; When Platform Collects Funds

Merchant of Record: In most cases the independent Service Provider is the merchant of record and receives payment directly. In limited or exceptional cases where ziatow.com / ziatowing.com explicitly indicates it is collecting payment on behalf of a Provider (and you receive written notice), ziatow.com / ziatowing.com will act as a collection agent and will process refunds, chargebacks, and disputes in accordance with this Policy and the applicable Processor terms. Such instances will be expressly disclosed at the time of checkout.

Records Retention: The Platform may retain transaction records, receipts, logs, and related documentation for a reasonable period for dispute resolution, fraud investigations, and regulatory compliance.
12. Representations & Warranties by Payor
By submitting payment, you represent and warrant that:

You are authorized to use the chosen payment method;

You will not initiate fraudulent chargebacks or false claims;

You will cooperate with reasonable inquiries by ziatow.com / ziatowing.com, Processors, Service Providers, and law enforcement; and

All information provided during payment or verification is truthful and complete.
13. Recovery of Fees & Remedies
If ziatow.com / ziatowing.com incurs costs, fees, fines, penalties, or chargeback fees due to your actions (including fraudulent chargebacks, false claims, or refusal to reimburse legitimate chargebacks), you agree to reimburse the Platform for all reasonable costs, including Processor fees, administrative fees, and attorneys’ fees incurred in collection efforts. The Platform may withhold funds, offset amounts owed, or pursue civil remedies.
14. Limitations of Liability (Payment Matters)
To the maximum extent permitted by law, ziatow.com / ziatowing.com’s liability for any payment-related claim, whether arising in contract, tort, strict liability, or otherwise, shall not exceed fifty U.S. dollars ($50.00) in the aggregate. This limit applies even if ziatow.com / ziatowing.com has been advised of the possibility of such damages.
15. Cooperation with Authorities
The Platform will cooperate with banks, Processors, card networks, law enforcement, and regulators in the investigation and prosecution of fraud. This cooperation may include disclosure of user identity information, transaction histories, IP addresses, and any other relevant data.
16. Amendments
ziatow.com / ziatowing.com reserves the right to modify this Payment & Anti-Fraud Policy at any time. Changes will be effective upon posting to the Sites. Continued use of payment services after changes are posted constitutes acceptance of the revised Policy.
17. Governing Law; Venue
This Policy is governed by the laws of the State of New Mexico and applicable federal law. Any disputes arising out of or related to payment or fraud matters shall be brought exclusively in the state or federal courts of Bernalillo County, New Mexico, and you consent to such jurisdiction and venue.

19. Final Advisory
This Policy is intended to allocate risk, deter fraud, and assist in recovery where fraud or disputes occur. It does not replace Processor terms, insurance, or local law requirements. If you anticipate frequent high-value transactions, multiple chargebacks, or complex billing arrangements, consult a licensed attorney and consider merchant account protections, enhanced fraud screening, or specialized insurance.
